DMCA and Copyright

Optic & Frame respects the intellectual property rights of others. Our photography is published under license, with permission, or from sources that permit republication with attribution, and our text is original editorial work. If you believe material on this site infringes your copyright, this page explains how to tell us and how we respond.

Designated contact

Send copyright notices through our contact page: choose the "Legal" topic or mark your message "DMCA". Direct email addresses will be published on the contact page once the publication's mailbox is verified; until then the contact page is the correct channel for copyright correspondence.

What a takedown notice should include

Under 17 U.S.C. 512(c)(3), a complete notice includes:

• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material claimed to be infringing and its location on our site (the full URL where it appears).
• Your name, address, telephone number and email address.
• A statement that you have a good-faith belief the disputed use is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
• Your physical or electronic signature.

Takedown procedure

We review complete notices promptly. Material found to infringe copyright is removed or disabled without undue delay, and we may notify the party who provided the material. We may remove or disable access to material where a notice is facially incomplete, and we keep a record of notices received. Accounts or contributors who repeatedly provide infringing material are treated as repeat infringers and may have material removed and access terminated.

Counter-notice

If material you provided was removed or disabled because of a copyright notice and you believe the removal resulted from a mistake or misidentification, you may send a counter-notice through the same channel, including the information required by 17 U.S.C. 512(g)(3): identification of the removed material and its former location, your contact information, a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification, your consent to the jurisdiction of the federal courts in your district, and your signature. Knowing misrepresentations in either a takedown notice or a counter-notice can give rise to liability under 17 U.S.C. 512(f).
